§1 Scope

These terms and conditions apply to all holiday programmes, childcare offers and children’s courses of the provider.

The contracting parties are the legal representatives of the registered child.

§2 Conclusion of contract

(1) Registration is made in writing, by email or via the registration form.
(2) The contract is concluded upon written confirmation.
(3) The number of participants is limited. Registrations are considered in the order in which they are received.

§3 Services

The scope of services is set out in the respective announcement.

Holiday programmes include in particular:

  • supervision during the stated times
  • a programme around animals, nature and everyday farm life
  • meals as stated in the announcement

§4 Terms of payment

(1) The participation fee is due within 14 days of the confirmation of registration.
(2) In the event of late payment, the provider is entitled to give the place to someone else.
(3) The statutory rules on default apply (§ 286 BGB, German Civil Code).

§5 Requirements for participation

Registration is made by the parents or legal guardians.

By registering, they confirm that:

  • the child is fit to participate in terms of health;
  • allergies, intolerances, chronic illnesses or necessary medication are stated completely and in writing;
  • the child has been informed of basic rules of behaviour when dealing with animals.

The provider reserves the right to exclude children from participation if information is missing or in case of health risks.

§6 Special features of the farm / note on liability

The parents or legal guardians are aware that a farm naturally involves risks (e.g. animals, machinery, uneven ground, weather).

Participation is at one’s own risk.

The provider is only liable for intent or gross negligence and, within the scope of the statutory provisions, for injury to life, body or health.

No liability is accepted for items brought along (mobile phones, clothing, toys etc.).

§7 Duty of supervision

The duty of supervision generally applies only within the advertised supervision times. It begins when the child is handed over in person to the supervising staff and ends when the child is collected.

Different arrangements (e.g. going home alone) require a written declaration.

§8 Withdrawal / cancellation

Cancellations must be made in writing.

The following conditions apply:

  • Up to 21 days before the start: free of charge
  • 20–10 days before the start: 50 % of the participation fee
  • From 9 days before the start or in case of non-attendance: 100 %

If the child is ill, a partial refund may be made on presentation of a medical certificate.

§9 Exclusion from participation

Children who repeatedly disregard safety instructions or endanger others may be excluded from participation.

In this case there is no entitlement to a refund.

Part B – Children’s courses on the farm

§10 Registration

Registration is made in writing by email by the parents or legal guardians. The contract is concluded upon confirmation.

For ongoing courses (e.g. weekly), the registration applies to the booked period.

§11 Course fees

(1) The participation fee is due within 14 days of the confirmation of registration.
(2) In the event of late payment, the provider is entitled to give the place to someone else.
(3) The statutory rules on default apply (§ 286 BGB, German Civil Code).

§12 Absences

Missed course dates can generally neither be made up nor refunded.

In the case of longer illness, an individual arrangement can be made by agreement.

§13 Cancellation by the provider

The provider reserves the right to cancel courses or holiday programmes in the event of:

  • too few participants
  • illness of the course leader
  • extreme weather conditions
  • force majeure

In this case the provider will propose an alternative date; if the participant cannot attend it, fees already paid will be refunded. There are no further claims.

§14 Clothing and equipment

Children must wear weatherproof, sturdy clothing and sturdy footwear.

No liability is accepted for soiled or damaged clothing.

§15 Photos and videos

Photos and videos are only taken with the written consent of the parents or legal guardians.

§16 Data protection

Personal data is used exclusively for organising and running the courses and holiday programmes and is not passed on to third parties unless there is a legal obligation to do so.

§17 Final provisions

Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected.

Place of jurisdiction is – as far as legally permissible – the registered office of the provider.
